1. Definitions

• "MyTopSpotify", "MTfS", "we", "us", or "our" refers to MyTopSpotify.io and its owners/operators.
• "Service" means the MyTopSpotify.io website and all services provided by the MyTopSpotify web application.
• "User", "you", or "your" refers to the person or entity using our Service.

• Not to modify or create derivative works based on the Spotify Platform, Spotify Service or Spotify Content;
• Not to decompile, reverse-engineer, disassemble, or otherwise reduce the Spotify Platform, Spotify Service, or Spotify Content to source code or other human-perceivable form, to the full extent allowed by law;

5. User Account and Responsibility

To access My Top Spotify's features, you must log in with your Spotify account.

You are solely responsible for maintaining the confidentiality of your Spotify login credentials and for all activities that occur under your account.

MyTopSpotify.io uses only a limited set of your Spotify data to provide our services. For more details, please refer to Privacy Policy > User account.

6. Intellectual Property

All content on My Top Spotify, including but not limited to design, graphics and text are owned by or licensed to My Top Spotify and protected by copyright and trademark laws.

7. Limitation of Liability

My Top Spotify provides the Service "as is" and "as available" without any warranties, either express or implied.

To the fullest extent permitted by law, My Top Spotify will not be liable for any direct, indirect, incidental, or consequential damages that result from the use or inability to use our platform.

My Top Spotify is solely responsible for MyTopSpotify.io and disclaims any and all liability on the part of Spotify and other third parties.

Spotify is a third party beneficiary of this end user license agreement and My Top Spotify's Privacy Policy, and is entitled to directly enforce this end user license agreement.

8. Indemnification

You agree to indemnify and hold MyTopSpotify harmless from any claims, losses, damages, liabilities, including legal fees, arising out of your use or misuse of the Service, violation of these Terms, or violation of any rights of a third party.

9. Termination

We reserve the right to terminate or suspend access to our Service immediately, without prior notice for any breach of these Terms.

10. Governing Law, Jurisdiction and Arbitration

These Terms shall be governed by the laws of the state of Victoria, Australia.

Any legal actions or disputes shall be filed in the courts of the state of Victoria, Australia, and you hereby consent to the jurisdiction of such courts.

For any dispute you have with MyTopSpotify, you agree to first contact us and attempt to resolve the dispute informally. If MyTopSpotify has not been able to resolve the dispute with you informally, we each agree to resolve any claim, dispute, or controversy by binding arbitration.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyTopSpotify regarding our Service and supersede and replace any prior agreements we might have had with you.
